Job Description of Manufacturing Business Division
Giving general safety & health inspections, working condition inspections, promoting labor laws and regulations, and offering services to the manufacturing business in the area under CRLIO's control.
Inspecting Area
Miaoli County , Taichung County (Tantzu Export Processing Zone excluded), Taichung City , Changhua County , Nantou County , and Yunlin County
Staffs
1 division chief, 1 senior mechanic, and 15 inspectors
Labor Inspection Laws & Regulations
- The Labor Inspection Law: Regulations mainly regarding scope of labor inspections, organizations proceeding labor inspections, labor inspectors, filling-in inspecting organizations & filling-in inspectors, inspecting procedures, etc.
- The Labor Standards Law: Labor condition matters mainly about labor hours, wages, rests, holidays & vacations, child labor & female labor, professional suffering compensation, etc.
- The Labor Safety & Health Law: Matters mainly about safety & health facility standards, safety & health education & trainings, special child labor & female labor care, contracting/sub-contracting management, labor safety & health working rules, etc.
- The Labor Insurance Act: Labor insurance, insurance premium, insurance settlement, etc.
- The Employee Welfare Fund Law: Labor welfare matters supposed to be settled by enterprises
- The Employment Service Act: Mainly about regulations, such as foreign labor employment, etc.
The Job of Manufacturing Business Division
- General Inspections:
The so-called “General Inspection” refers to non-periodical inspections given to enterprises and proceeded by inspectors. The inspections include working conditions, general safety & health, labor welfare, etc.
Priorities for inspections are given to :
(1) Enterprises having significant professional sufferings
(2) Enterprises not conforming to laws and regulations, and being stated, appealed, or reported by laborers or labor unions
(3) Enterprises about to have significant and immediate dangers
(4) Enterprises having accidents, such as fires, explosions, leakage, collapsing, etc.
- pecial Inspecting Project:
Inspections given in terms of special problems or specific enterprises. For instance, large-scaled working condition special inspecting projects, batch-manufacturing chemical factory safety & health special inspecting projects, mechanical suffering prevention special inspecting projects, petrifaction business & large-scaled chemical factory special inspecting projects, liquefied petroleum gas consuming place special inspecting projects, large-scaled high-pressure gas facility safety special inspecting projects, foaming plastic (butane-used) manufacturing factory safety & health special inspecting projects
Dangerous Working Place Verifying & Inspecting:
The Manufacturing Division mainly focuses on
(1) Working places doing petroleum cracking works
(2) Firecracker & firework factories and gunpowder manufacturing places
(3) Working places dealing with the amount of manufacturing, handling, and using dangerous materials reaches the limit set by the central superintendent authorities
Verifications and inspections are carried in advance to prevent sufferings from happening.
Matters Handled after Inspections
For enterprises violating labor-related laws and regulations, the following procedures will be taken respectively by the government offices in accordance with different situations
- Entirely Suspending:
Inspecting organizations must inform enterprises to entirely suspend their current works when professional sufferings are about to occur or have already occurred to prevent sufferings from occurring or being worsened.
- Partially Suspending:
Inspecting organizations must inform enterprises to partially suspend their current works when violating labor safety & health laws and regulations, failing to improve by given deadlines, or professional sufferings about to occur or having already occurred.
- Correcting or Improving (within a time limit):
In addition to the above-mentioned situations, inspecting organizations can inform enterprises to correct or improve the drawbacks found within a time limit if enterprises violate general working conditions or have poor labor safety & health facilities.
- Fining: Enterprises violating The Labor Inspection Law or having poor labor safety & health facilities should be fined by CRLIO.
- County/City Government Fining:
Enterprises violating general working conditions and supposed to be fined by County/City governments should be fined accordingly.
Being transferred to courts:
Enterprises seriously violating working conditions or having poor labor safety & health facilities should be transferred to courts for administrative penalties.
